Temporary Operating Permit

Certain applicants can obtain a permit to operate while the application is pending. The application for the temporary operating permit should be filed with the application for the license, or anytime thereafter. The following applicants are eligible for temporary operating permits:

  • retail applicants buying the business from the existing licensee (also referred to as a “transfer” application);
  • new businesses applying for an on-premises license or a grocery store; and
  • applicants for manufacturer licenses.

Temporary Operating permits are granted at the discretion of the Authority and may be renewed for an additional 30 days.

Temporary Operating Retail Permit Fee for on-premises beer, grocery or drug store applicants: $128

Temporary Operating Retail Permit Fee for all other retail applicants: $640 (each bar on the premises is subject to this fee)

Temporary Operating Permit Fee for Manufacturers: $125

Liquidator's Permit

If you are going out of business, you may sell your inventory of alcoholic beverages to the buyer, to a wholesaler, or to other licensed retailers. However, before doing so you must obtain a liquidator’s permit from the Authority. If you are on the delinquent list because of unpaid bills with a wholesaler, you will not be able to get a liquidator’s permit.

This application for a liquidator's permit is submitted by the retail licensee who is selling or liquidating their business. The liquidator's permit is valid for one transaction only and requires the sale of the entire stock of alcoholic beverages in closed containers by the permittee. When the sale is approved, an inventory signed and dated by the permittee (the seller), listing the type, brand name, size and number of containers of alcoholic beverages to be sold, must be submitted to the Authority.

Solicitor Permits

Solicitors are representatives of wholesalers and manufacturers. A Solicitor's Permit allows a representative to sell any alcoholic beverage on behalf of the wholesaler or manufacturer whose name appears on the license and that the solicitor represents. 

Solicitor Permits are not required for individuals who are soliciting orders on behalf of a micro or farm manufacturer.

Three-Year Solicitor Permit Fee: $98 

 

A Temporary Solicitor's Permit authorizes a manufacturer or wholesaler to temporarily employ one or more persons as a temporary solicitor for a period not exceeding 6 months, provided that within 60 days after such employee has been employed as a solicitor, that employee files an application for a Solicitor's Permit with the Authority.

Three-Year Temporary Solicitor Fee: $134

Solicitor Transfer Application

If approved by the Authority, this application authorizes a solicitor to transfer their existing permit to a new employer.

Sunday On-Premises Sales Permit

A Sunday On-Premises Sales Permit authorizes an on-premises licensee to sell alcoholic beverages for consumption on the licensed premises on Sunday between the hours of 8AM and 10AM. The application for this permit must be received by the Liquor Authority a minimum of 15 business days prior to the event. 

Applicants must notify their local municipality of their intent to apply for the Sunday On-Premises Sales Permit at least 30 days prior to the submission of the permit application by using the attached notification form. A copy of the completed notification along with proof of mailing or hand delivery from the municipality must be submitted with the application.

The applicant may apply for up to 12 permits per calendar year. The permit is limited to on-premises locations outside of New York City.

One Day Trucking Permit

A One Day Trucking Permit authorizes a one day permit for a specific vehicle to transport alcoholic beverages to and/or from a location in this state. The permit certificate, identifying the vehicle and the effective date(s) and time(s) of the permit, shall be kept in the cab of the vehicle at all times that alcoholic beverages are transported in the vehicle.  

A permit shall be valid for a period not to exceed twenty-four consecutive hours. No more than twelve (12) permits may be issued in any consecutive twelve-month period to the person or for the same vehicle.

Vehicles must be owned, leased or hired AND operated by the applicant.

    This permit application should be used by individuals who wish to receive a one day permit for a specific vehicle to transport alcoholic beverages.

Wine/Liquor Auction Permit

A Wine/Liquor Auction Permit authorizes an individual to conduct up to 12 auctions during the calendar year. Only retail off-premises licensees who have been licensed for ten years or more may apply for this permit. 

The permittee may also conduct wine tasting on the premises of any location approved by the Authority for conducting wine/liquor auctions.

New York State Fair Permit

Per Section 97-B of the ABC Law, this permit authorizes the sale of alcoholic beverages by the permit holder at the New York State Fair.

Off-Site Event Permit

Allows an off-premises catering licensee to obtain an off-site event permit to serve alcoholic beverages. Such premises must have suitable and adequate facilities and accommodations to provide food and service for not less than fifty persons.
